Well, this question has been clearly answered in the Chapter 520: because Kabuto was not able to find Jiraiya's body (probably sunk in the ocean depths) and he [Kabuto] had no DNA sample for Jiraiya.
Something like that.
Agreed, we know that what are the requirements to summon the dead through the justsu.

I find meaningless that Kabuto had Asuma's and Hizashi's dna and he doesn't have a bit of Jiraiya's one.Uh how can he know HOW jiraiya has been killed,and hurt with Pain's weapon,and have not soome of his dna?he should have some because he fought him,as he,or better Orochimaru, has Dan's dna. the possibilities are:
1) Kabuto lied to Tobi about jiraiya(sorry I didn't write it,thanks to "Steelwingcrash1")
2)Kabuto is an idiot....(so this isn't a possibility because Kabuto is a genius,indeed,THE genius)
3)Kishi did an epic fail!

i feel the really confusing this is why didnt he summon orochimaru, he definitely has enough dna... since he couldnt have implanted all of the remaining traces into himself, also i think the whole jiraiya thing was answered since he also mentioned how there could be traces left on pain's weapons.
Orochimaru has been sealed by Itachi. So no way for him to be resurrected.
But he also isn't the kind of normal guy at all. That his chakra remnants may be so powerful is very fishy. That may be linked to what Kabuto has up his sleeve.
