Each zanpakutou spirit is born from a shinigami since birth. So when a shinigami dies, their zanpakutou's soul vanishes which makes the sword an empty shell(My speculation). As with tousen's case, i'd like to think that his soul infused itself into his dead friend's sword since he had not owned a sword back then.
next chapter is gonna come out! I believe we will see driscol falling down and yama heading to buckbeard,who has just thrown away kenpachi. and maybe we will get to see who killed kirge
hopefully the scene shifts to rose or shunsui ...these 2 fights are promising
and hopefully no more ichigo getsuga tenshoing the jail again -_-
And where did the whole "Tousen's Zanpakutou came from his friend" come from anyway? I don't recall him ever saying that.
That always seemed to indicate that the whole zanpakuto dying with it's master was more of a general trend than a strict rule. From what we've seen it seems like they do live on but it is a rare occurrence that they would serve anyone else. Combining that fact with Byakuya's misconceptions on achieving bankai and the whole current bankai stealing fiasco seems indicate that a lot of the stated rules about zanpakuto are based on convention and observation rather than hard science.
I'm really looking forward to the next chapter. I'd really like to see how well the other SR are wielding their stolen bankai particularly Bambi. Something about Komamura's bankai and shikai clashing appeals to me.

It's more like a moment where Tousen adopted his own sense of justice and took the sword for himself as a symbol. Go back to Ichigo regaining his shinigami power before the SS arc. His zanpakutou was originally Rukia's, same hilt and everything. Yet, it transformed into Zangetsu. Zanpakutous are just the embodiment of the spirit within the shinigami, and can change every time they want, as seen from Urahara's sword turning into a cane or Yamamoto's switching between a sword and a cane. When Tousen's friend died he probably took the spiritless zanpakutou and adopted it as it's own, eventually making his own spirit to inhabit the sword. But this is not one of those flashbacks meant to be taken seriously, they are the ones used to represent something.
OK let's stop the Tousen thing and come back to the real question: Can Yamo take Sasakibe's Bankai and use it as his own? I'd say he can but he wont, instead he'd break it or bury the medallion along with Sasakibe.
