they can use everything they showed so far and have all the info on each other they shared in the manga
only Edo Madara is excluded and no other restrictions whatsoever
Kabuto doesnt have Edo Tensei Army at ready and Tobi doesnt have bijuus and gedo mezo gathered . they have to summon them first
Nagato could control the GM statue himself and same for the jins that Tobi has...
Kabuto said it wouldn't be smart to go against the Rinnegan at that moment. He obviously believed he would eventually have to go against it, he just wanted it on his terms.
Anyway, Kabuto wins with what he has shown. Between either of his sonic attacks, he should be able to catch Tobi off guard fast enough to land a blow. And given that he knows the make-up of the Zetsu bodies, he should have a good idea of what can do Tobi damage. At the very least, chakra absorption should do the deal.
Kabuto said " I can't go against the Rinnegan for now " that's true, and when he said it, he already had this Sennin mode and creepy mode as his power anyway.
And Kabuto didn't show anything to counter the Rinnegan, and more his S/T technique.
He said he would be in trouble if he had to fight the Rinnegan there, though there was no need to panic because he had plenty up his sleeves. He just didn't want to start a fight at that moment.
The only Rinnegan ability Kabuto wouldn't be capable of countering is the soul stealing. All the other Rinnegan abilities can be handled by his unique body and Sage Mode.
Just his S/T and intangibility would give Kabuto enough trouble, let alone Rinnegan abilities on top of that.
Kabuto's White Rage and Tayuya's Phantom Sound Chain would both be capable of preventing Tobi from fully defending from Kabuto's attacks. Neither of those are things that Tobi can block/evade and once they're in action, Tobi focusing enough to employ his abilities would be questionable. It's not as if Kabuto is unaware of Tobi's abilities. He knows what Tobi can do, while Tobi knows little of what Kabuto can do, meaning Kabuto has the advantage here. Kabuto also has a whole collection of fighters to call upon to attack in his place.
Those " fighters " won't do anything against him and you know it. Summoning Gedo Mazo and the Jinchuurikis wouldn't take that much of time, and them alone can easily hold all of his Edo Tensei.
Maybe Tobi won't be able to block that White Rage technique, but that wouldn't stop him... Itachi was able to use Susanoo in that condition, Tobi would be able to use Shinra Tensei to push Kabuto back until the technique is over. Nothing too hard, again, that Phantom Sound technique is nothing, it's not like Tobi gonna sit and do nothing, he'd use his intangibility and try to hide to surprise Kabuto, remember than when he's in that state, nobody can feel his chakra, so Kabuto's sensory abilities wouldn't work, at least until the very moment when he'll show up.
Hanzou (his poison), Itachi (obviously), Nagato (his own Rinnegan abilities), and KinGin (sacred tools) would all be capable of taking Tobi down when given an opening, which Kabuto can provide. And as far as we've seen, Tobi doesn't have the ability to summon his Edo Paths. The Gedo Mazo can be taken by Nagato, or at the very least kept occupied with each attempting to control it.
The White Rage would cause Tobi concentration problems, which would lessen his ability to counterattack. And Shinra Tensei won't mean much against someone who knows about it and has a body that can be crushed with no ill effect. Not to mention, with either Edo Itachi or Edo Nagato to back him up, Kabuto can easily allow a hit by Shinra Tensei to give them the opportunity to strike in the cooldown. The Phantom Chain sound would prevent Tobi from going any place, at least until he can break it, which again would grant Kabuto's forces the chance to take him down.

Yeah, have to agree with Rikudo king here. Kabuto has far too much going for him.
He has shown better resilience than Tobi with his water body. He has better summons in my opinion - except perhaps Gedo Mazo, but as Rikudo King has pointed out, Nagato can try to wrest control of this from Tobi. He has shown better Genjutsu and Taijutsu than Tobi. And better offensive Ninjutsu (though Tobi's phantom thing is pretty OP). Not only that, but he can summon Nagato who has access to all of the fancy Rinnengan techniques that Tobi now has.
Kabuto has too many 1 hit KO techniques now that he also has Itachi's, Nagato's and the Kin Gin brothers techniques.
Sure, the tailed beast bodies are pretty good, but even with them Tobi is still too lacking in power to win.
Kabuto may have an army of zombies, but if Tobi has the Rinnegan and is able to use its powers (which I doubt because I think he's bluffing, he has a Sharingan and hasn't used its powers at all, either) and he hasn't been shown doing anything else besides the ability to connect with the six paths, so given the OP, he can't use it in this battle (so far). The reason I bring it up is because if Tobi is able to use Human Realm's abilities, he can simply remove the souls from the zombies. Tobi might be able to phase and teleport, use the Gedo Mazo, summon and control the tailed beasts, and have 100,000 White Zetsu clones, but that fails before Kabuto's zombie army. The 3rd Raikage alone can probably take care of all the White Zetsu (who wouldn't be powered up because it was Kabuto who did that, anyway) besides all the other zombies he has that can easily take care of the 100,000 clones along with the Raikage (Muu, Kakuzu, Kimimaro, Hanzou, Ginkaku and Kinkaku). As for dealing with Tobi, I think that Kabuto could probably deal with him by himself but he can just really use Itachi and Nagato and that would be overkill. If Minato alone was able to one-shot Tobi and own him enough to have him warp away and bide his time, Kabuto with Itachi and Nagato are going to erase his existence. And if I wanted to be realistic, all Itachi has to do is use his Totsuka Sword and game over.

DUH!.. and if he was fast enough to snatch Sasuke at the Kage Summit and almost got Minato, then he can no doubt grad Kabuho... everything else would be invalid because what you cannot touch you cannot hurt.... all useless power... oh fyi: Madara would make no difference.. meteor and tree would also be useless..... Mind you this would be easily done if he was smart.

Problem being for Tobi, he can only remain a ghost for five minutes. In addition, to preform any physical attack, he'll have to go solid. We've seen multiple people take advantage of those facts in order to touch and land a hit on him, even when they didn't have all the information. So Tobi will have to risk being hit in order to land a finishing hit himself. With his sensoring ability, Kabuto would be aware of Tobi when he's solid, meaning it'll be very hard for Tobi to catch Kabuto off guard.
