Well.. Just because Burgess is part of the crew which will fight the SHs in the end of the story, does not mean he can not lose right now.
Oda can always overpowers him with a fruit later on and that fruit does not have to be Ace's fruit.
Also, dunno if someone has mentioned this before yet...
