They probably still have the written consent of that noble, it's now legally OK. I can see the new fishmen pirates hiding that paper somewhere, maybe that's why Luffy shoulndn't fight or FI could lose their chance at moving to the surface.

The goal of FI this entire time has been to move to the surface. If Luffy destroys FI somehow, they'll all HAVE to go to the surface.
