As far as we know, the key to gaining Eternal Mangekyou Sharingan requires an eye transplant from an MS user to another MS user.
Well, what exactly stops two MS users from simply trading eyes? Either Kishi is going to retcon later that it isn't a simple transplant (that both eyes will somehow be necessary to form the EMS eyes, resulting in the original eyes being useless), or Madara and his brother were just complete idiots.
