Well guys this does it for me. Goodnight .
Also in some sad news, a cousin of mine who just had a kid less than a week or so has a hernia next to his groin.
So any peeps that pray here, have him ( Luka ) in your thoughts /prayer.
I still can't believe that the pants were the sole reason for the dismissal of the allegations - whether that is just my personal naivety to the stupidity of people, or that I am right and there surely was other (stronger) evidence given (and the pants were just the thing the media latched on to as a strong 'talking point'), I'm not quite sure.
After reading that article, I believe it‘s the latter. It was part of the closing statement, and got rightfully noticed by people due to how wrong such a statement is on so many levels. But feel like many only understand this as the sole reason he was acquitted, which I can‘t believe to be likely. Even Orgz said in his post that was the reason for it, without that actually being said anywhere from what I read. So the outrage is quite heavily misdirected, and should be more directed at the lawyer and bad lawyer practices than at the justice system and saying „that‘s the reason people get away wih it nowadays!“. Rape cases, both real and fake, are very difficult to actually prove or disprove if you only have two people saying different things. Must be a pretty shitty type of cases for judges to preside over actually, because unless there‘s big evidence for either conclusion then it‘s quite a toss up.
But this taught me today what a thong with a lace front is
Was signing up for that planned? If you don‘t mind me asking. Since just a few days ago you wanted to do uber work but now you signed up for a similar position you used to work in, albeit most likely without all the horrible parts you had to endure back there.

Yeah, I worded it a bit wrong in my first post due to frustration, but like I explained in the other post, what I’m really mad with is the fact that this can be held as any sort of “evidence”, that the victim wearing a certain thing can still be used as a way to cast the blame on her. Even if there was more substantial evidence (though if there was, I don’t see why she’d use this in her closing argument), that in itself is enough to raise protests for sure.
And indeed, the actual protesting is about that - the #thisisnotconsent thing is directed at the fact that these sort of things can still be used as evidence to free a potential rapist.
But anyway, I just wanted to vent a bit because it stirred up a lot of memories from personal (though second-hand) experiences. Enough about this for now.

Do you know if it was actually used as evidence by the court? Seems more to me like it was part of the lawyers words, and those can mostly say whatever. I think it was the lawyers intention to use that as some sort of convincing evidence, but doubt that specifically was written down anywhere in the procedure as one of the things the judge considers. Maybe only his closing statement in general.
If the court used that in the decision then it‘s another matter, but I think it was only evidence in the eyes of the lawyer who said that in hopes to affect someone. Don‘t know if it was used directly as evidence as you say.

But yeah don‘t need to talk about this. It‘s maybe just me being naive in thinking that can‘t come anywhere close to evidence, even slightly on the same ground as testimonies of people involved.

Well they do have a juror system, meaning the closing argument is from the lawyer to the jury (in this case 8 men and 4 women). So yes, it is seen as evidence because it’s there to “win over” the jury who cast the final verdict.
“Although it’s unclear whether the jury was influenced by the display of the underwear, at issue for many is the fact that Ireland has no specific law regarding whether such evidence should be used to impugn someone’s character or virtue. As a result, jurors must weigh the value of such items as evidence.”
The only other pieces of info I’ve found from the trial is this: “The jury of eight men and four women heard from the defendant at trial. He reportedly testified he and the teen had been “attracted to one another” and she consented to sex.
Prosecutor Tom Creed argued a witness allegedly said the defendant had his hand on the teen’s throat.
“She is quite clear she did not consent,” Creed said in court. “She said she never had sexual intercourse before.”
But anyway, let’s really drop the topic now, I keep getting angry over and over again and this is supposed to be a “Fun Thread”.
